These terms apply to quotes, samples and production orders placed with Mike Apparel, Wazirabad Road, Sialkot 51310, Pakistan. Placing a sample or bulk order confirms acceptance of these terms. Specific terms on a signed quote or pro-forma invoice take precedence where they differ.
Quotes
Quotes are valid for 30 days and are based on the specification, quantity and delivery terms stated. Changes to fabric, decoration, quantity or destination may change the price. Prices are in US dollars, FOB Sialkot unless DDP is stated.
Samples
Sample fees are payable in advance and are credited against a bulk order for the same style placed within 90 days of sample delivery. One revision is included; further revisions are charged at cost. Samples remain the property of the client once paid for.
Orders and payment
Bulk orders are confirmed on written approval of the pre-production sample and receipt of a 50% deposit. The balance is due before shipment. Production does not begin until the deposit is received, and goods are not released until the balance is paid. Late payment may delay shipment and, where storage is required, incur storage charges.
Minimums and changes
The minimum order is 50 pieces per design and colourway unless otherwise agreed. Quantity and size breakdown may be changed until cutting begins. Design changes after cutting require a new sample and may incur additional cost and time.
Lead times
Stated lead times are estimates from sample approval and deposit. We will notify you of any delay as soon as we become aware of it. Lead times exclude transit, customs inspection and events outside our control.
Quality and claims
Goods are inspected against the approved sample before shipment. Claims for defects or shortages must be made within 14 days of delivery with photographs. Confirmed defects are remedied by replacement, repair or credit at our discretion. Normal variation in garment-washed and dyed products, and measurement tolerances of ±1.5 cm on body and ±1 cm on trims, are not defects.
Intellectual property
Artwork, patterns and designs you supply remain yours, and we use them only to produce your orders. Blocks and patterns developed by us for your styles are held on file for your reorders and are not supplied to other clients. You warrant that you have the right to use any artwork you send us.
Shipping and risk
For DDP shipments, risk passes to you on delivery to the stated address. For FOB shipments, risk passes when goods are handed to the carrier in Sialkot. All shipments are insured for invoice value; we manage claims for DDP consignments.
Confidentiality
We do not publish client names, designs or order details without permission, and will sign a mutual NDA on request.
Governing law
